General Terms and Conditions

I. General information
- The following General Terms and Conditions for Cinema Subscriptions (hereinafter "Subscription") apply exclusively to the conclusion of subscription contracts for a subscription to CINFINITY GmbH, Theaterplatz 1, 23909 Ratzeburg, hereinafter CINFINITY.
- CINFINITY sells the respective subscription and becomes the customer's contractual partner.
- These GTC apply exclusively in relation to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession.
II Conclusion of contract/parties to the contract
- The subscriptions offered by CINFINITY on its homepage and the CINFINITY app constitute a non-binding invitation to the customer to conclude a subscription contract (so-called Invitatio ad offerendum).
- After selecting a subscription, the customer enters the data required to conclude the contract (full name, address, e-mail address, payment method and details)
- On the following contract conclusion page, the customer places a binding order to purchase the selected subscription by clicking on the "Buy now" button.
- Employees of Akzeptanz-Kinos and their family members are excluded from concluding a subscription contract.
- CINFINITY shall immediately confirm receipt of the customer's order and the conclusion of the contract by e-mail. The contract is concluded upon receipt of this confirmation email from CINFINITY by the customer.
- The text of the contract will not be saved by CINFINITY and can no longer be retrieved after conclusion of the contract. The customer has the option of retrieving and saving the contractual provisions, including these GTC, upon conclusion of the contract.
- The contract is concluded exclusively in German.
III. Contents of the CINFINITY subscription
- The subscription is personal and cannot be transferred to third parties.
- Upon presentation of the personalized CINFINITY app, the subscription entitles the subscriber to attend any number of regular film screenings at the acceptance cinemas. This applies provided that tickets are available for the respective movie screening at the acceptance cinema and the FSK rating (age restriction) is observed.
- The subscription entitles the holder to a maximum of three parallel bookings in one or more acceptance cinemas. As soon as one of these bookings has been completed by attending the screening or a previous cancellation, a further booking can be made, so that a maximum of three bookings are possible at the same time.
- This subscription does not include special screenings, third-party screenings, festivals of the respective Acceptance Cinema. Special events, e.g. live broadcasts, premieres, third-party film festivals, non-public events, third-party events and events with special surcharges as well as 3D screenings are also not included in the subscription. Surcharges - independent of CINFINITY - may be levied by the acceptance cinemas for these events. These surcharges will be expressly pointed out during the booking process.
- The acceptance cinemas will be listed on the CINFINITY homepage in a constantly updated list.
- The General Terms and Conditions and the respective house rules of the acceptance cinemas apply to ticket bookings and movie attendance. These also apply in particular to cancelations of booked tickets.
IV. Prices and payment
- The subscription prices shown on the homepage are in euros and include statutory VAT.
- Contract processing, invoicing and payment collection are carried out exclusively by CINFINITY.
- Payment of the subscription price is due monthly or annually (depending on the subscription model chosen by the subscriber) in advance. The first payment is made immediately after conclusion of the contract, subsequent payments are due at the beginning of the following contract month.
- Payment by the customer shall be made via one of the payment options offered by CINFINITY and selected by the customer when concluding the contract.
- If the customer chooses payment by direct debit (SEPA mandate), the direct debit shall be made within one month of the invoice date to the account specified in the invoice.
V. Right of withdrawal for subscription contracts
Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of conclusion of the contract.
To exercise the right to cancel, you must inform us (Cinfinity GmbH, Theaterplatz 1, 23909 Ratzeburg, widerruf@cinfinity.de) of your decision to cancel this contract by a clear statement (e.g. letter, fax or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
In order to maintain the right of withdrawal, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of revocation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for the repayment. After receipt of your revocation, your personal CINFINITY app access with which you can make use of CINFNITY services will be closed.

Exclusion of the right of withdrawal
If you have already used the subscription before the end of the withdrawal period, you must pay compensation for this use. In this case, you must pay the service rendered, i.e. one monthly subscription fee.
VI Term/cancellation/termination of the subscription offer
- The term of a subscription is between 4 and 12 months, depending on the customer's choice. This is the contract period.
- At the end of the contract period, the subscription can be terminated with one month's notice.
- The subscription can be terminated at any time at the end of the current contract period with one month's notice. Text form is sufficient for termination, i.e. termination can be made by e-mail; in the event of termination by the customer, this must be sent to kuendigung@cinfinity.de
- An extraordinary right of termination for good cause is not affected by this and is available to each party at any time.
An important reason is in particular
- Incorrect information provided by the subscriber to CINFINITY.
- Abusive or fraudulent use of the subscription
- Passing on the personalized CINFINITY app to third parties.
- Default of payment
- The elimination of the most frequently used Acceptance Cinema if there is no other Acceptance Cinema within a radius of 25 km from the customer's place of residence.
If the subscription contract ends due to extraordinary termination by CINFINITY for good cause before the contractually agreed minimum term of the subscription contract, the subscriber shall owe the subscription price until the end of the minimum term.
- CINFINITY reserves the right to discontinue the subscription services completely at any time. Should CINFINITY make use of this right, CINFINITY shall only be liable for damages to subscribers to the extent prescribed by law. Any further liability on the part of CINFINITY is excluded. In this case, any overpaid subscription costs will be refunded to the subscriber within 14 days.
VII Warranty
The statutory warranty rights apply to all products offered.
VIII. Liability
- CINFINITY shall be liable without limitation for intent and gross negligence.
- In the event of a slightly negligent breach of a primary performance obligation, CINFINITY's liability shall be limited to the direct damage foreseeable at the time of conclusion of the contract and typical for the contract. Principal obligations are obligations whose breach jeopardizes the achievement of the purpose of the contract or whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the customer may regularly rely.
- CINFINITY's liability shall be excluded in the event of a slightly negligent breach of an ancillary contractual obligation.
- Insofar as CINFINITY's liability is excluded or limited under these rules, this shall also apply to employees, executive bodies and vicarious agents of CINFINITY.
- The limitations and exclusions of liability in clauses 2-4 shall not apply in the event of mandatory statutory strict liability, in the event of the assumption of a no-fault guarantee and in the event of injury to health, body or life.
IX. Consumer dispute resolution
CINFINITY is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board in accordance with the German Consumer Dispute Resolution Act (VSGB).
X. Final provisions
- The law of the Federal Republic of Germany shall apply.
- If general terms and conditions have not become part of the contract in whole or in part or are invalid, the rest of the contract shall remain valid. Insofar as the provisions have not become part of the contract or are invalid, the content of the contract shall be governed by the statutory provisions.
